In a recent development, the High Court has issued a conservatory order blocking the Interior Ministry’s proposal to deploy Kenyan police officers to Haiti, a mission endorsed by the United Nations Security Council (UNSC) to restore peace in the troubled Caribbean Island.
Justice Chacha Mwita, presiding over the case filed by the Third Way Alliance and Miruru Waweru, issued the order, restraining the government from deploying 1,000 police officers to Haiti or any other country until October 24, 2023.
The legal challenge raised concerns about the move’s legality, potentially affecting the US-backed mission.
The petitioners, represented by Ekuru Aukot, argued that the deployment required further scrutiny, given its potential impact on national interests.
The case was filed against key respondents, including the Cabinet Secretary of Interior and Coordination of National Government and the Speaker of the National Assembly, among others.
Justice Mwita emphasized the importance of the issues raised in the petition, deeming them of national significance and requiring urgent consideration.
As part of the court’s ruling, the respondents were instructed to file their responses within three days of service.
Furthermore, the ruling outlined that the petitioners would have three days following service to submit supplementary affidavits, if necessary, along with written submissions, limited to a maximum of 10 pages.
