Chuka High Court is set to make a ruling on the application by Director of Public Prosecution (DPP) to terminate anticipatory bail order to four of the six suspects in the murder of Daniel Mutembei from Nkwego village in Tharaka Nithi County.
Tharaka-Nithi County DPP officer Felister Njeru told the court on Wednesday morning that her office had gone through the investigation file and recommend arrest and prosecution of the six for murder which happened a month ago.
The DPP also sought warrant of arrest order for one of the suspect who is subject to the anticipatory bail who did not avail to record statement with the Director Criminal Investigation (DCI) and for the other two.
Ms Njeru said the suspects needed to be arraigned as early as possible because the matter had led to demonstrations which have interfered with activities in Chuka town.
“We are asking for the cancellation of the anticipatory bail order for the four suspects and a warrant of arrest order for three,” said Ms Njeru.
The suspect’s counsel, Tito Towett challenged the application by the DPP for the cancellation of the anticipatory bail and sought for the extension arguing that their clients are in danger.
She claimed that she received an anonymous call on Sunday and informed that there were plans to torch Chuka Police Station on Monday once the suspects are locked there.
Lady Justice Lucy Gitari said she will issue judgement for the two applications later in the day.
Elected leaders led by Chuka Igambang’ombe MP Patrick Munene and his Maara counterpart Kareke Mbiuki and Speaker John Mbabu attended the court proceedings.
Almost all elected Members of Tharaka-Nithi County Assembly also attended the seating led by Majority Leader and the Magumoni MCA Justin Kithinji.
