High Court has stopped the newly appointed 50 Chief Administrative Secretaries (CASs) from assuming the office pending hearing and determination of a case filed by Katiba Institute and the Law Society of Kenya.
Justice Hedwig Ongundi issued the interim orders which also bar the CASs from payment of salary or any other benefit from the government.
The orders have also dealt a huge to President William Ruto who rushed to give the oath of office to the CASs as the cases against the appointments were being raged in the court by the petitioners who want the position declared illegal.
However, the Attorney General successfully applied the name of the President struck out of the petition arguing that the petitioners errored in suing the President in his personal capacity.
The National parliament also declined to vet the CASs pointing out that there is no provision in the 2010 Constitution giving them the responsibility.
Many Kenyans have also faulted the move by President Ruto to appoint the 50 CASs while the country is struggling with a very bad economy.
